(AUS) Hells Angels nominee Benjamin Pegoraro abandons court appeal over speeding conviction

THE younger brother of wounded Hells Angels Daniel Pegoraro has abandoned a court appeal over a speeding conviction.

Through his lawyer, Benjamin Pegoraro today requested the County Court appeal hearing be adjourned due to his older brother's plight and family concerns for Daniel's welfare in hospital.

Defence counsel Dave Cronin, of Turnbull Lawyers, applied for the adjournment, telling Judge Geoffrey Chettle that Benjamin was dealing with family concerns at hospital - where he was on "standby".

Daniel Pegoraro, 28, was shot at least three times in his lower back and torso in his parents' driveway on Sunday night.

He had emergency surgery at Royal Melbourne Hospital and is recovering.

The heavily tattooed Daniel is a member of the Hells Angels. Benjamin, 23, also sports distinctive facial tattoos and is a patched member of the Red Devils, a known feeder group of the Hells Angels.

This morning, Judge Chettle said he would not adjourn the matter.

"He was able to get his picture in the paper this morning," Judge Chettle said of Benjamin.

"His brother seems to be all right. He (Benjamin) should be here."

The matter was stood down while Mr Cronin made a phone call.

Upon his return Mr Cronin informed the court that Benjamin wished to abandon the appeal.

Benjamin did not appear at court.
